The Consumer Product Safety Improvement Act of 2008 ("CPSIA") was signed into law on August 14, 2008. The original CPSIA law required manufacturers and importers of products manufactured on or after November 12, 2008 to certify that their products comply with all applicable Consumer Safety Act rules and similar rules, bans, standards and regulations under any other laws administered by the Consumer Product Safety Commission ("CPSC"). According to the CPSIA, the process was to be accomplished by issuing a certificate specifying each rule, ban, standard, or regulation with which the product must comply. Such certification must be based on a test of each product or upon a reasonable testing program.

On January 30, 2009 the CPSC announced that it was issuing a Stay of Testing and Certification Requirements for Certain Products. The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay. Despite this "stay," Roche has decided to immediately comply with the new certification requirements for its products that are subject to the CPSIA regulations (i.e., those products that are subject to child-resistant packaging requirements by providing the required certifications by electronic means).
